Former Student Files Title IX Lawsuit Against Anderson University

A former Anderson University student has filed a Title IX lawsuit against the school for not investigating his sexual assault complaint against members of a football team.

The lawsuit was filed in October at Madison County Circuit Court 1, wherein the plaintiff has alleged three footballers of assault in the fall of 2016, the same year when he was hired to play baseball for the school team.

In court filings, the former student has alleged the football team members of attempting to rape him in October 2016 while he was playing a video game in his dorm.

In November 2016, the student was again attacked by the players forcing his parents to report the incident with the university’s police department. The police responded by making two arrests, but both of the suspects were released after the dismissal of charges.

The lawsuit further alleges university of retaliation, “by failing to protect him; failing to allow him to finish his academic year; failing to instruct his professors to reasonably accommodate the plaintiff to finish his classes; failing to allow him to take spring semester classes; failing to allow him to participate in baseball, essentially retaliating against him by expelling him from college.”

Meanwhile, the university on Thursday filed a motion to move the lawsuit from county court to a federal court in Southern Indiana.
